Sweepstakes may only be entered in or from the 50 United States and the District of Columbia and entries originating from any other jurisdiction are not eligible for entry. This Sweepstakes is governed exclusively by the laws of the United States. You are not authorized to participate in the Sweepstakes if you are not located within the 50 United States or the District of Columbia .
1. How to Enter. Enter information in the form above and follow the directions to enter between [12:01am] [ET] on [July 9, 2007] and [11:59pm] [ET] on [August 20, 2007]. You must include on the online entry form your name, address, zip code, email address, date of birth, and phone number. All entrants must have a valid email address.
Limit 1 entry per person/email address. No automated entry devices and/or programs permitted and all such entries will be void. All entries become the sole and exclusive property of the Sponsor and receipt of entries will not be acknowledged or returned. Delivery of prizes requires a street address (no P.O. Boxes). Released Parties (as defined below) are not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, which will be disqualified, or for problems or errors of any kind whether mechanical, computer, network, typographical, printing, human, electronic or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize or in any Sweepstakes-related materials. Only fully completed entry forms are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
2. Start/End Dates. Sweepstakes begins at [12:01am] [ET] on June 26, 2007] and ends at [11:59pm] [ET] on [August 20, 2007].
3. Eligibility. Participation open only to legal residents of [the fifty United States and the District of Columbia ] who are 18 or older as of date of entry. Void in [SET FORTH WHERE VOID], outside of the 50 United States and the District of Columbia , and where prohibited, taxed or restricted by law. Employees, officers, directors & consultants of SESAC (“Sponsor”), SPIN, The Alex Hotel & Orbitz, anyone associated with RUSH, and their respective parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers and distributors of sweepstakes materials, and their immediate families (parents, children, siblings, spouse and their respective spouses, regardless of there they reside) or members of the same household (whether related or not) of such employees/officers/directors/consultants are not eligible to enter or win. All applicable federal, state and local laws and regulations apply.
4. Random Drawing/Odds. Potential winner will be selected in a random drawing on or about [August 22, 2007] from all eligible entries received. Odds of winning depend on the number of eligible entries received for the drawing. Drawing will be conducted by Sponsor. By entering the Sweepstakes, entrants fully and unconditionally agree to be bound by these rules and the decisions of the Sponsor and judges, which will be final and binding in all matters relating to the Sweepstakes.
5. Prize. One (1) Grand Prize: Winner will receive a trip to see RUSH perform at Madison Square Garden scheduled to take place on [insert date]. Trip includes round-trip coach class air transportation for two (2) from the major U.S. gateway airport nearest winner’s residence (as determined by Sponsor) to New York City , two (2) nights standard accommodation (one (1) room, double occupancy) at The Kimberly Hotel a Meet & Greet with RUSH, two (2) tickets to the concert , and the RUSH “Snakes & Arrows” CD. Approximate retail value of prize: $3500.00. Actual value may vary based on winner’s city of departure. Winner and guest must travel together on the same itinerary and are responsible for obtaining all necessary travel documents. If winner resides within a 100-mile radius of destination, Sponsor reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Travel must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to winner. Certain travel restrictions may apply. Winner is solely responsible for all expenses, costs or fees associated with acceptance and/or use of the prize not specified herein as being awarded including, without limitation, any and all taxes, ground transportation, meals, gratuities, and souvenirs. Winner’s guest must be of the legal age of majority in his/her state of residence (and at least 18 years of age), unless accompanied by a parent or legal guardian, and must execute and return a liability/publicity release prior to issuance of travel documents. If guest is a minor in his/her state of residence, minor’s parent/legal guardian must execute and return all releases on behalf of minor. Tickets are subject to terms and conditions. Seat locations will be determined by Sponsor. Winner and guest must comply with all stadium rules and regulations. Failure to do so may result in such prize portion. Prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Prize is non-transferable. No substitutions or cash redemptions permitted by winner. Sponsor reserves the right to substitute the prize (or portion thereof) of comparable or greater value, at its sole discretion. All prize details are at Sponsor’s sole discretion.
6. Notification. Potential winner will be notified by telephone and will be required to execute and return, where legal, an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days of date of prize notification. [If winner is at least 18 but considered a minor in his/her jurisdiction of residence, such documents must be signed and returned by his/her parent or legal guardian and such prize will be delivered to minor’s parent/legal guardian and awarded in the name of parent/legal guardian and parent/legal guardian will be responsible for fulfilling all requirements imposed on winner set forth herein. Parent/legal guardian of minor winner will be required to accompany such winner as his/her guest on trip. If potential winner cannot be contacted within five (5) calendar days of first notification attempt, if prize or prize notification is returned as undeliverable, if potential winner rejects his/her prize or in the event of noncompliance with these rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner will be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given.
7. Conditions. Participation in Sweepstakes and acceptance of prize constitutes winner’s permission for Sponsor and its designees to use his/her name, address (city and state), likeness, photograph, picture, portrait, voice, biographical information and/or any statements made by winner regarding the Sweepstakes or Sponsor for advertising, promotional or other purposes in any and all media now or hereafter known worldwide without limitation and without notice or additional compensation or permission, except where prohibited by law. By participating, entrantsagree to release and hold harmless Sponsor, SPIN, The Alex Hotel & Orbitz, anyone associated with Rush, and their respective parent companies, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers and distributors of sweepstakes materials and all of their respective partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, “Released Parties”), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with participation in Sweepstakes, or possession, acceptance and/or use or misuse of prize (or any travel or activity-related thereto) or participation in any Sweepstakes-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Released Parties are not responsible if Sweepstakes cannot take place or if prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism.
8. Additional Terms. In case of dispute as to the identity of any entrant, entry will be declared made by the authorized account holder of the email address submitted at time of entry provide he/she is eligible according to these rules. “Authorized Account Holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential winner may be requested to provide Sponsor with proof that such winner is the authorized account holder of the email address associated with the winning entry. Any other attempted form of entry is prohibited; no automatic, programmed; robotic or similar means of entry are permitted and all associated entries will be void. Released Parties are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Sweepstakes or downloading any materials in this Sweepstakes.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Sweepstakes should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may, at its discretion, select the winner from all non-suspect, eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or website or who is otherwise in violation of these rules and void all associated entries. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives and void all associated entries.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Use of Data. Sponsor will be collecting personal data about entrants online, in accordance with its privacy policy. Please review the Sponsor’s privacy policy on the enry form.. By participating in the Sweepstakes, entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s privacy policy.
